These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and the operator of SoulTale ("I," "me," "my," "SoulTale," or "we") regarding your access to and use of the SoulTale website, including any content, digital products, subscriptions, email communications, and donation features (collectively, the "Service").
By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the Service.
By making a purchase, subscribing, donating, or providing your email address through the Service, you represent and warrant that:

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Voluntary Subscription. By providing your email address to SoulTale through any signup form, you expressly consent to receive email communications from me, including but not limited to:
Double Opt‑In Confirmation. To ensure compliance with international privacy laws (including GDPR), SoulTale uses a double opt‑in process via MailerLite. After submitting your email address, you will receive a confirmation email. You must click the confirmation link to complete your subscription. If you do not confirm, your email address will not be added to the mailing list.
Opt‑Out and Unsubscribe. You may withdraw your consent and unsubscribe from email communications at any time, for any reason, by:
I will process your unsubscribe request promptly, typically within five (5) business days. Please note that even after unsubscribing from promotional emails, you may still receive transactional or administrative messages related to any active subscription or purchase you have made.
Data Handling. Your email address and any associated data are handled in accordance with the SoulTale Privacy Policy, which complies with the Philippine Data Privacy Act (RA 10173), the EU General Data Protection Regulation (GDPR), and other applicable international privacy laws. I do not sell, rent, or trade your email address to third parties for their own marketing purposes.
Subscription Plans. SoulTale offers monthly and annual subscription plans granting access to all premium content during the active subscription period. Plan details and pricing are displayed at the point of purchase in United States Dollars (USD) unless otherwise stated, and are subject to change with reasonable notice.
Auto‑Renewal. Unless you cancel before the renewal date, your subscription will automatically renew for the same duration at the then‑current rate. You may cancel auto‑renewal at any time through your Payhip account settings or by contacting Payhip support.
Payment Processing. All payments for subscriptions and digital products are processed by Payhip and PayPal. SoulTale does not collect or store your payment card details. You are subject to Payhip's and PayPal's respective Terms of Service and Privacy Policies.
Currency and Conversion. All prices are listed in USD. If you are paying from a country outside the United States, your payment provider may apply currency conversion rates and additional fees. SoulTale is not responsible for such fees.
Value Added Tax (VAT) and Sales Tax.
SoulTale offers digital products for sale, including but not limited to ebooks. Upon successful payment, you will receive access to download the purchased digital file(s) via Payhip. You are granted a limited, non‑exclusive, non‑transferable, worldwide license to download and use the digital product for personal, non‑commercial purposes only. Redistribution, resale, public sharing, or uploading of digital products to file‑sharing platforms is strictly prohibited.
No Refunds on Digital Goods. Due to the intangible nature of digital content and immediate access upon purchase, all sales of digital products and subscription fees are final and non‑refundable. By completing a purchase, you acknowledge and expressly waive any right to a refund, chargeback, or reversal.
EU/UK Consumer Right Exception: Under EU Directive 2011/83/EU and UK Consumer Rights Act 2015, consumers located in the European Union or United Kingdom normally have a fourteen (14) day right of withdrawal for online purchases. However, this right does not apply to digital content where performance has begun with your prior express consent and acknowledgment that you thereby lose your right of withdrawal. By completing a purchase of digital content or subscription on SoulTale, you expressly consent to immediate access to the digital content and acknowledge that you waive any statutory right of withdrawal.
Donations. Donations made via "Feed Cubby" (Ko‑fi) are voluntary gifts of support and are non‑refundable.
Technical Issues Exception. If you experience a technical issue preventing access to purchased content despite reasonable troubleshooting, please contact me at Liemar10@proton.me within seven (7) days of purchase. I will make a good‑faith effort to resolve the issue or provide an alternative remedy at my sole discretion. This does not affect your statutory rights under applicable consumer protection laws.
Written Content. All original written stories, articles, and text appearing on SoulTale are the exclusive intellectual property of the site operator and are protected under Philippine copyright law (Republic Act No. 8293), the Berne Convention for the Protection of Literary and Artistic Works, and other applicable international copyright treaties. You may not reproduce, distribute, modify, publicly display, or create derivative works from the written content without express prior written permission.
Images. Images on SoulTale are AI‑generated and subsequently edited by hand. The final edited images are considered original works of SoulTale. Unauthorized extraction, reproduction, or use of these images is prohibited.
Historical Subjects. SoulTale stories are creative interpretations based on historical figures and events from the 19th century and earlier. Names are presented as first name and last initial only. The content does not constitute professional historical, legal, or genealogical advice.
User License. Subject to your compliance with these Terms, you are granted a limited, revocable, non‑exclusive, non‑transferable, worldwide license to access and view the content solely for personal, non‑commercial purposes. This license does not include any right to scrape, data mine, or otherwise extract content by automated means.
You agree not to engage in any of the following prohibited activities, regardless of your location:
Violation of this section may result in immediate termination of your account and access to the Service, including cancellation of any active subscription without refund, removal from email lists, and may subject you to legal action in the appropriate jurisdiction.
I reserve the right, in my sole discretion, to suspend or terminate your access to the Service, including any paid subscription, account, or email subscription, for any reason or no reason, with or without notice. Grounds for termination include but are not limited to:
Effect of Termination. Upon termination for cause, you will lose access to all premium content and digital products associated with your account, you will be removed from email communications, and no refund will be issued for any remaining subscription period or prior purchases.

Your interactions with third‑party services are governed by their respective terms and policies, and you agree that SoulTale shall not be liable for any loss or damage arising from such interactions.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SOULTALE MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
You acknowledge that your use of the Service is at your own discretion and risk. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE OPERATOR OF SOULTALE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
Notwithstanding anything to the contrary herein, the total aggregate liability of SoulTale to you for any claims arising from or relating to these Terms or the Service shall not exceed the greater of (a) the total amount paid by you to SoulTale during the twelve (12) months immediately preceding the event giving rise to the claim, or (b) One Hundred United States Dollars (USD $100.00).
Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.
You agree to defend, indemnify, and hold harmless the operator of SoulTale, and any respective agents, successors, and assigns, from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:
Governing Law. These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without giving effect to any conflict of law principles.
International Users. SoulTale is operated from the Philippines and is intended for a global audience. By using the Service from outside the Philippines, you agree that Philippine law governs these Terms, and you consent to the jurisdiction of Philippine courts. You are also responsible for compliance with all local laws applicable to your use of the Service.
Dispute Resolution. Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall first be attempted to be resolved through good‑faith negotiations. If the parties are unable to resolve the dispute within thirty (30) days, the dispute shall be submitted to the exclusive jurisdiction of the competent courts located in the Republic of the Philippines.
You hereby irrevocably consent to the personal jurisdiction of such courts and waive any objection based on improper venue or forum non conveniens.
EU/EEA/UK Consumers: Nothing in this section limits any mandatory consumer protection rights you may have under the laws of your country of residence. If applicable law in your jurisdiction requires that disputes be heard in your local courts, this provision shall not apply to the extent it conflicts with such mandatory rights.
I reserve the right to modify or replace these Terms at any time. If a revision is material, I will provide notice by updating the "Last updated" date at the top of this page and, for active subscribers or email list members, may provide additional notice via email or prominent site announcement at least thirty (30) days before the changes take effect.
Your continued use of the Service after any such modifications constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must discontinue use of the Service and cancel any active subscription.
These Terms are written in the English language. In the event of any translation or localized version of these Terms, the English language version shall prevail and be controlling.
